modus5.com (the "Site") is operated by Modus5 LLC ("Modus5," "we," "us," or "our"), a New York limited liability company located at 295 Madison Ave 2nd floor, New York, NY 10017. We are the controller of the personal information described in this policy.

This policy applies to the Site and to any products, services, or communications that link to it (together, the "Services").

• Transaction records: as required by tax law, typically 7 years.
• Analytics data: 14 months.

When information is no longer needed, we delete or anonymize it.

Security

Modus 5 uses administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit (HTTPS) and access controls, consistent with New York's Stop Hacks and Improve Electronic Data Security (SHIELD) Act. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a breach that affects you, we will notify you, and where required the New York Attorney General and other authorities, as required by New York General Business Law § 899-aa and other applicable law.

Your rights

Depending on where you live, you may have the right to:

• Correct inaccurate or incomplete information.
• Delete your personal information.
• Restrict or object to certain processing, including direct marketing.
• Receive your information in a portable format.
• Withdraw consent where processing is based on consent.

U.S. state privacy rights

Modus 5 is a New York company, and New York residents may contact us at any time with questions about their information or to request access, correction, or deletion. Residents of California and other U.S. states with comprehensive privacy laws (such as Colorado, Connecticut, Virginia, and Texas) have additional rights, including the right to know what categories of personal information we collect, use, and disclose; to request deletion or correction; and to opt out of the sale or sharing of personal information and of targeted advertising.

In the past 12 months we have collected the categories described in Information we collect: identifiers, commercial information, internet or network activity, approximate geolocation, and professional information. We disclose these for the business purposes described in How we share information.

We do not sell personal information. We do not knowingly sell or share the information of consumers under 16. We will not discriminate against you for exercising your rights.

International transfers

Modus 5 is based in New York, United States, and our service providers may process information in other countries. When we transfer personal information out of the EEA, UK, or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses or the EU–U.S. Data Privacy Framework where applicable.

Children's privacy

The Services are not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has given us personal information, contact us and we will delete it.
